4WD TOURING AUSTRALIA – Beyond Terms and Conditions

By entering the “4WD TOURING AUSTRALIA – Beyond” competition, you are agreeing to the following terms and conditions:

1. STANDARD TERMS

1.1     Information on how to enter forms part of the terms of entry.

2. WHO CAN ENTER?

2.1    Subject to clause 2.2, entry is open to all residents of Australia over 18 years of age.

2.2    Employees and their immediate families of 4WD Touring Australia and their associated agencies and companies are not eligible to enter.

3. HOW TO ENTER

3.1    The competition commences on 1 April 2017 and closes on 27^th May 2017.

3.2    Entry is via:

3.2.1  Online entry form at https://4wdtouringaustralia.com.au/pages/beyond - 1 free entry. One free entry is obtained by entering the form online via www.4wdtouring.com.au/pages/beyond. Only one online entry per person per residency or email address is permitted.

3.3    Incomplete, indecipherable, or illegible entries will be deemed invalid.

3.4     Entries must be received by midnight of each TV episode’s on air date in the competition period: April 1, April 8, April 15, April 22, April 29, May 6, May 13, May 20, May 27.

3.6    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4.        PRIZES

4.1    There will be one winner each week. The winner will receive one set of MaxTrax (comprising two MaxTrax recoveD set (series 1-4) including freight to the winner’s address.

4.3    PRIZE ACCEPTANCE: Prize cannot be redeemed for cash. Prize is not transferrable. The prize will be delivered to the winners address.

4.4    In participating in the competition, the winner agrees to participate and co-operate as required with all editorial activities relating to the competition, including, but not limited to being interviewed and photographed for publication in 4WD Touring Australia Magazine. The winner agrees to grant the Promoter a perpetual and non-exclusive licence to use such editorial and photographs in all media worldwide, and as such the winner will not be entitled to any fee for such use.

4.5    The collection, use and disclosure of personal information provided in connection with this promotion is governed by 4WD Touring Australia’s Privacy Notice.

4.6    Prizes cannot be redeemed for cash. Prize is not transferrable.

5.        HOW TO WIN

5.1     Entry is by filling in the form at https://4wdtouringaustralia.com.au/pages/Beyond with entrants’ details and answering the question each week correctly.

5.2     The winning entry will be chosen by Carlisle Rogers. The winner will be notified by email and phone

5.3     All entries become the property of the Promoter, Escape Media Pty Ltd, PO Box 825, Mooloolaba, Qld 4557, and may be used in future marketing promotions. The promoter takes no responsibility for any late, lost or misdirected entries.

• The judges’ decision in relation to any aspect of the conditions will be final and binding on every person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected mail.

• The prize is not transferable, redeemable or exchangeable and cannot be taken as cash. The complete prize will be delivered to the winners address.

• The prizes depicted in all promotional materials are not necessarily the same colours as the prize.

• By entering the competition, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in.

6.        NO LIABILITY

• The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or inconsequential loss) or for personal injury which is suffered or sustained, as a result of taking the prize, except for any liability which cannot be excluded by law. It is a condition of accepting the prize that the winner (and companion) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

• In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.

• Escape Media & affiliates and associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.4    Escape Media & affiliates will not be liable for any misadventure, accident, injury, loss or claim that may occur:

1. a) during the draw;
2. b) whilst undertaking any activity in or connected with their entry into the draw;
3. c) in the participation in any prize;
4. d) as a consequence of late, lost or misdirected mail;
5. e) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
6. f) in relation to failure of an entry to be received by the promoter on account of technical problems or traffic congestion;
7. g) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this promotion;

6.5     Escape Media assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.

6.6     If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.
